Terms of Service

§ 1 Scope
These Terms of Service govern all contracts between Nuh Kayran, Sulgauer Str. 28, 78713 Schramberg ("margord") and businesses (within the meaning of § 14 BGB, "Customer") regarding the use of the platform at www.margord.com and app.margord.com. We do not contract with consumers (§ 13 BGB).
§ 2 Service
margord provides a SaaS platform on which agencies and restaurants run white-label ordering experiences ("storefronts"). Feature scope is described on /platform and /pricing.
margord is a technical service provider. Contracts between restaurants and their end-customers are concluded directly between them; margord is not a party to those orders.
§ 3 Conclusion of contract
The contract is concluded when the Customer signs up at app.margord.com and is confirmed by margord (typically automatically). Sign-up implies acceptance of these Terms and the current Privacy Policy.
§ 4 Plans, prices, billing
Current plans and prices are listed at /pricing:
- Hobby: free for one restaurant, limited features.
- Pro: €20 / month plus metered usage (in particular 0.5% revenue overage above €5,000 / month, image storage, custom domains).
- Enterprise: by individual agreement.
Plans are billed monthly in advance. Usage-based fees are billed at the end of the billing period. All prices exclude VAT where applicable.
Payments are processed by Stripe Payments Europe Ltd. By providing a payment method, the Customer authorizes margord to collect amounts due.
§ 5 Availability
margord targets 99.9% annual availability. Planned maintenance windows are scheduled — where possible — outside typical order hours (12-2 PM and 6-10 PM Central European Time).
Force majeure, supplier outages (e.g. Cloudflare, Stripe), and lawful suspensions for non-payment or terms violations are excluded from availability.
§ 6 Customer obligations
The Customer agrees not to misuse the platform. In particular:
- no illegal, harmful, defamatory or spam content,
- no fake, test or otherwise manipulated orders,
- reasonable security for the account and any Stripe API keys,
- correct presentation of restaurants to end-customers, including imprint, privacy policy, allergens and other mandatory disclosures (LMIV).
margord may suspend affected restaurants or accounts without prior notice on breach.
§ 7 Data processing
Where margord processes personal data on behalf of the Customer (e.g. the Customer's restaurant end-customers), the parties enter into a Data Processing Agreement under Art. 28 GDPR upon request. Until then, our standard DPA terms apply (available on request).
§ 8 Liability
margord is liable without limitation for intent and gross negligence, for damages from injury to life, body or health, and for claims under the Produkthaftungsgesetz.
For ordinary negligence, margord is only liable for breach of essential contractual obligations. In such cases liability is limited to the typically foreseeable damage, capped at the platform fees paid by the Customer in the affected contract year.
Liability for lost profits, indirect damages or data losses beyond the recovery points documented in our backups is excluded.
§ 9 Term and termination
The contract runs indefinitely. Either party may terminate with 14 days notice to the end of a billing period, via the dashboard or by email to hello@margord.com. The right to extraordinary termination for cause remains unaffected.
After termination margord makes the Customer's data available for export for 30 days; thereafter it is deleted, subject to legal retention obligations.
§ 10 Changes to these Terms
margord may amend these Terms. Changes are announced by email at least 6 weeks before they take effect. Changes are deemed accepted unless the Customer objects within 6 weeks of receipt. The right to object and the consequences are highlighted in the change notice.
§ 11 Final provisions
German law applies, excluding the UN Sales Convention. Place of performance and exclusive jurisdiction is Schramberg, Germany, where the Customer is a merchant, legal person under public law or special fund under public law.
If any provision of these Terms is invalid, the remaining provisions are unaffected. The invalid provision is replaced by the legally permissible rule that comes closest to the economic intent.
